If so, you are required to complete declaration formalities with the CCIN (Commission for the Control of Nominative Information) to avoid penalties.


 Who is concerned?

 

All Monaco-based companies that collect and use personal information through computerised or electronic means. For  example:

 

  • Collecting all customer and prospect information

  • Using a Website

  • AML/CFT verification

  • Using personnel management software

  • Using professional email

  • Implementing a biometric system to allow access to commercial premises

  • Installing video surveillance cameras and security system in the company

 

What is nominative information?

 

Any information that directly or indirectly identifies a person. For example:

 

  • Identification number

  • Social security number

  • Full name

  • Postal address

  • Telephone number

  • Business email address

  • Vehicle registration number

 

How do I complete the required formalities?


The CCIN provides four declaration forms on its website:


               1- The request for authorisation

 

For automated processing involving data related to suspected illegal activities, offences, or biometric data necessary for identity verification. For example:

 

  • AML/CFT verification

  • Video surveillance system

  • Biometric access control

 

               2- The request for opinion:

 

This procedure is a very exceptional measure for the Monegasque State and public entities. Examples:

 

  • Labour Department

  • National Education

  • Monaco Telecom

  • SMA

  • SMEG


               3- The simplified declaration:

 

For processing activities that do not infringe on the rights and freedoms of individuals. For example:

 

  • Managing personnel administration

  • Handling customer and prospect information

  • Overseeing supplier relationships

  • Managing fixed and mobile phone services

 

               4- The ordinary declaration:


Processing that goes beyond the guidelines set by Ministerial Order or where no Ministerial Order exists. For example:

 

  • Operating a website

  • Using a professional email service without monitoring
